You are asking a valuable question but it is a secondary one.
How dare you challenge the law? They will probably have you locked up for a tort to insight a breach of the Law. (Probably me too for political reasons after this entry.)
Look, we cannot promote our own workforce first because we are part of the EU. That would be illegal.
You should be asking why we are in the EU when most of us do not want to be there.
Some of the reasons are:-
Most of us want democrasy. If we don't like our government we can vote them out (eventually). We can't do that with our European Lords & Masters.
Most of us don't want to fund the EU's unaudited spending.
With the £40 billion the EU costs us each year, we could look after our people better. (Alright argue about the number but whatever the number is it is very very big!)
My personal one is that I don't like us starving Africans to death by barring their trade to support EU farmers. Did you vote for that policy? Or the current costly "Butter Mountain" and the insanity of the CAP?
I could go on and on and on but I hope I have made my point.
The essence of your question is somewhat more valid than the religious one about how many angels can dance upon the head of a pin but like that, it really is a secondary one. We all need to be asking if we want to be in the EU. After that we can question the consequences of such decisions.

I can't see why Total have come so unstuck on this one. They're saying the Italian workers are employed on the same pay and conditions. In that case why not open recruitment up?The dispute isn't over employing UK workers above anyone else. The dispute is because Total have allowed their contractor UK workers from the roles.
I've just blogged about the energy gap in the UK and the demands it's going to place on recruitment over the next few years. It's unlikely we're going to be able to source all the engineers we need for the amount of work needed in the power generation sector. Employers will need to look further afield but they're going to need to do that in a more open way than has been seen this week.
On a side note - it's rare I disagree with Tom and while I appreciate that are differing views on how Europe is run it's important to note that 47% of our trade comes from the top seven EU countries alone.
